Article 1 – Definitions

In these terms and conditions the following definitions apply:

Withdrawal period:    the 14-day period within which the consumer can make use of his right to return;

You:                           a consumer (the natural person who does not act in the exercise of a profession or business and who enters into an agreement with THE COSTUME SHOP);

Right to return:           consumer’s right to return the goods within the withdrawal period;

Model form:               the model form provided by THE COSTUME SHOP for customers to fill in if they want to make use of their right to return.

Entrepreneur:             the natural or legal person who offers products and/or services to consumers at a distance;

Article 3 – Applicability

These Terms and Conditions apply to every (online) offer from THE COSTUME SHOP and to every (online) online agreement between you and THE COSTUME SHOP. They are provided prior to placing an order.

Article 4 – The offer

The pictures of the suits are a true representation. However, THE COSTUME SHOP cannot guarantee that the colors shown exactly match the real colors of the suits.

Article 5 – The agreement

The agreement is concluded when you place an order. As long as THE COSTUME SHOP has not yet confirmed that order, you can dissolve the agreement.

Article 6 – Right of withdrawal

When can I cancel?

You may cancel the agreement within 14 days without stating reasons. This cooling-off starts on the day after you have received your order.

How can I let you know that I want to cancel?

If you want to make use of your right to return, you are obliged to inform THE COSTUME SHOP within 14 calendar days of receipt of your order via the return form that you received with your order confirmation or after reporting your return via stating the order date, order number, your name, address and the reason for return. After submitting the return form, you have 14 calendar days to return the product with Track & Trace, at your own expense.

Be careful while fitting

I spend a lot of time and care designing and producing the suits. I would therefore like to ask you to handle the one or more packages that you have ordered and its packaging very carefully during the cooling-off period. You can no longer exchange a damaged suit.

How can I return it?

Are you unexpectedly not satisfied and do you want to make use of your right to return? Then send your order (or part thereof) in its original condition and with the original packaging to THE COSTUME SHOP according to the instructions provided.

Article 7 – Refund

If you have already paid, THE COSTUME SHOP will refund this amount as soon as possible, but no later than 14 days after cancellation, provided that THE COSTUME SHOP has received your return or that you can show conclusive proof of a complete return. If you return the complete order, you will also receive a refund of the shipping costs.

Article 8 – The price

All prices include VAT and are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors. In case of printing and typesetting errors, THE COSTUME SHOP is not obliged to deliver the product according to the incorrect price.

Article 9 – Conformity and Warranty

The items are carefully checked before shipping. Everything has been carefully tested: the buttons, the zippers and the fabric. We always try to look for a solution, but each package is checked by us with love because we do not work with mass production but only produce a small edition. We therefore do not guarantee buttons, zippers and color differences after washing. The washing instructions are clear. This is a beautiful handmade product, made with love, so treat it with love! Is there something wrong with your order? Let THE COSTUME SHOP know in writing within 4 weeks of receiving your order.

Article 10 – Delivery and execution

THE COSTUME SHOP will take the greatest possible care when receiving and executing orders.

The delivery time is stated on the website. If delivery is delayed, or if an order is not or only partially carried out, you will receive notice as soon as possible but no later than 7 days after you placed the order. In that case you may cancel the agreement free of charge. You are not entitled to compensation.

If the delivery of (part of) your order turns out to be impossible, THE COSTUME SHOP will contact you for a replacement article. The risk of damage and / or loss of products rests with THE COSTUME SHOP until the moment of delivery to the consumer or a previously designated and notified to THE COSTUME SHOP representative, unless otherwise expressly agreed.

Article 11 – Complaints

Do you have a complaint about your order or the execution of the agreement? Please let THE COSTUME SHOP know in writing within 7 days after you found the defect. 

THE COSTUME SHOP will do its best to answer the complaint as soon as possible, but within 14 days at the latest, or indicate if that is not possible.

Article 12 – Disputes

Agreements between THE COSTUME SHOP and you, to which these general conditions apply, are exclusively governed by Dutch law. Even if you live abroad. The Vienna Sales Convention is not applicable.
